Article 1: General provisions
The e-commerce website of 'Secret Horse Box' (hereafter referred to as SHB), offers its customers the possibility to purchase the products from its web store online.
These Terms and Conditions apply to every order placed by a visitor to this e-commerce website (hereinafter referred to as "Customer"). When placing an order via SHB's web shop, the Customer must explicitly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, excluding all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless these have been accepted by SHB in advance in writing and explicitly.
Article 2: Price
All prices quoted are expressed in EURO, always including VAT and all other taxes or duties that are mandatory for the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The indication of price refers exclusively to the articles as described verbally. The accompanying photos are intended to be decorative and may contain elements that are not included in the price.
Article 3: Offer
Even though that the online catalog and the e-commerce website are compiled with the greatest possible care, it is nevertheless possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind SHB. SHB is in no way liable in the event of manifest material errors, typing or printing errors.
If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we ask the Customer to contact our customer service in advance.
The offer always applies while supplies last and can be adjusted or withdrawn at any time by SHB. SHB cannot be held liable for the unavailability of a product. If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.
Article 4: Online purchases
The purchase is made by placing an order through the web shop system and subsequently making the payment.
The order is only effective after receipt of payment on the account of SHB.
The Customer has the choice between the following payment methods:
* Via credit card (visa, master card)
* Via bancontact
* Via PayPal
SHB is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regarding orders in which the Customer is involved.
Article 5: Delivery and implementation of the agreement
For orders of the special editions of the 'Secret Horse Box', the Customer is assumed to be sent only on the date stated therein.
Other orders except for one-off offers from the webshop are sent on Tuesday, Wednesday, Thursday and Friday, unless one of these days falls on a French holiday.
Items ordered through this web store are delivered exclusively in Metropolitan France, Belgium and the Netherlands.
Delivery is made by Mondial Relay to a collection point of choice for Metropolitan France, Belgium and the Netherlands.
The average time that the package is on its way is 3-5 working days for Metroplitan France and Belgium and 5-7 working days for the Netherlands and the U.K.
Shipping is free for purchases of €50 and above for France and Belgium.
For an order with a purchase amount less than € 50, € 5 shipping for Metropolitan France and Belgium and € 6 shipping for the Netherlands will be added.
For an order with a purchase amount between 50.01€ and 79.99€, 5€ shipping for the Netherlands.
For the UK:

Maximum weigth: 10 kg.
Unless otherwise agreed or explicitly determined otherwise, the goods will be delivered to the Customer's within 30 days of receiving the order.
Any visible damage and / or qualitative shortcoming of an item or other shortcoming in delivery must be reported by the Customer to SHB without delay.
The risk of loss or damage is transferred to the Customer from the moment he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by SHB.
If the customer does not collect his / her ordered goods from the relay point on time, they will be automatically returned. If the order is canceled, the full amount of shipping (as stated with Mondial Relay) will be deducted from the refund. If the customer wishes the goods to be sent again, he / she must first pay the full amount of the shipment. (See also article 7: Right of withdrawal).
Article 6: Retention of title
The delivered articles remain the exclusive property of SHB until the moment of full payment by the Customer.
The Customer undertakes, if necessary, to remind third parties of the retention of title of SHB, for example to anyone who would come to seize the articles that have not yet been fully paid.

Article 7: Right of withdrawal
The provisions of this article only apply to Customers who purchase articles online from SHB in their capacity as consumers.
The Client has the right to withdraw from the contract within 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day:
a) for agreements where the Customer has ordered several goods in the same order that are delivered separately: "on which the Customer or a third party designated by the Customer, who is not the carrier, physically acquires the last good."
b) for contracts relating to the delivery of a goods consisting of several shipments or parts: "on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the last shipment or part."
c) for contracts for the regular delivery of goods during a certain period: "on which the Customer or a third party designated by the Customer, who is not the carrier, physically acquires the first good."
To exercise the right of withdrawal, the Customer must inform SHB via a clear statement (e.g. in writing by post or e-mail) of his decision to revoke the agreement. The Customer can use the enclosed model form for withdrawal for this, but is not obliged to do so.
In order to comply with the withdrawal period, the Customer must send his notification regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return the goods to SHB without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to revoke the agreement to SHB. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods are for the account of the Customer.
If the value of the returned product is reduced in any way, SHB reserves the right to hold the Customer liable and claim damages for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to determine the nature, characteristics and operation of the goods.
Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back. The items in the Secret Horse Box are considered as 1 item.
If the Customer revokes the agreement, SHB will refund all payments received from the Customer up to that time, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after SHB has received all the goods, or until the Customer has demonstrated that he has sent back the goods.
Any additional costs resulting from the Customer's choice for a different method of delivery than the cheapest standard delivery offered by SHB will not be reimbursed.
The Customer cannot exercise the right of withdrawal for:
· The delivery of goods that spoil quickly or with a limited shelf life;
· The delivery of sealed goods that are not suitable for being returned for reasons of health protection or hygiene and of which the seal has been broken after delivery;
- the delivery of goods that by nature are irrevocably mixed with other products after delivery;
- the delivery of newspapers or magazines with the exception of contracts for a subscription to such publications;
- agreements concluded during a public auction;
- the delivery of goods that are specially ordered for the customer;
- the delivery of goods obtained with a discount;
Article 8: Warranty
Under the law of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Every commercial guarantee does not affect these rights.
To invoke the guarantee, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
If a defect is determined, the Customer must inform SHB as soon as possible. In any case, any defect must be reported by the Customer within a period of 1 month after it has been determined. Afterwards, any right to repair or replacement expires.
The (commercial and / or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy use, poor maintenance, or any other abnormal or incorrect use.
Defects that manifest themselves after a period of 6 months following the date of purchase, delivery, if any, are deemed not to be hidden defects, unless the Customer proves otherwise.

The customer service of SHB can be reached via telephone, e-mail or by post [see above]. Possible complaints can be directed to this.
Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights held by SHB, in the event of non-payment or late payment from the date of the default, the Customer owes an interest of 10% per year on the unpaid amount without notice. In addition, the Customer is legally and without notice required to pay a lump sum compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.
Notwithstanding the foregoing, SHB reserves the right to take back articles that are not (fully) paid.

If necessary, you can also request to correct the data that would be incorrect, incomplete or not relevant.
In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. You can always contact SHB for this.
We treat your data as confidential information and will not pass it on, rent it or sell it to third parties.
The customer is responsible for keeping his login details confidential and the use of his password. Your password is stored encrypted, so SHB has no access to your password.
